Unfortunately the "3 feet" law doesn't necessary protect us from this kind of mishap, however, a harsher punishment will make motorists be more respectful/careful around cyclists on the road. This should be push for an involuntary manslaughter charge or vehicular manslaughter charge. Either charge will mandate some jail time. If you are around Gville a long time like me, then you'd remember Tom Hayes III who was killed on 441 when a driver fell asleep, drifted into a bike lane, and rear ended Tom. That driver got away with a careless driving ticket, $500 fine, and 22 hrs of community services. A life of a person only worth $500 and a silly fine? We have people in jail for a lot less of a crime like possession of an illegal substance. Please let me know if I can help in any way. Thanks.
